Oshawa Auto Insurance News

Several proposed class-action lawsuits launched against some notable insurance companies in Ontario claim that the companies have been going against the laws governing payouts and defrauding victims of auto accidents for years.

The lawsuits allege that in some cases the companies failed to reimburse or pay HST on benefits but included HST in the calculation of benefits entitlements in some other cases. These violated the rules set in 2010.

Paul Harte, a lawyer belonging to the team that filed the legal action said that the insurers defrauded victims of auto accidents by reducing care benefits to injured individuals in order to boost its profitability. The allegations contained in the lawsuit have not been proven in court. The suit named the following insurance companies: Intact, Aviva, Unifund, Certas, Allstate, and Belair.

According to the legal action, the Financial Services Commission of Ontario has been aware of the HST issue for years but did not take action against it.
